It gets better I have since been told that the car is an MOT failure. I wanted to see if there were any issues and so got the garage to put it in for a MOT. @ 9582d , Having been in the motor trade ( for a good number of years ) including the retailing of Cars , I would strongly advise mentioning going to Trading Standards  and The Office of Fair Trading when you next meet up with the dealers  , and make it clear that it's  NOT an empty  threat , it is simply going to be your next course of action , if your unhappy with the way they treat your complaint , be firm and positive  , the law is in your favor .

On top of what all the issues with the car it has also failed the MOT! It was MOT last week with no advisories. MOT on thursday and failed on brake issues and headlights. It also had advisories regarding suspension, driveshaft and steering. I have emailed the dealer yesterday with a copy of all the faults found and notified them it also failed the MOT. I haven't heard back as of yet, but will chase them up today.

When was the MOT issued and was it done by the seller? The car was picked up on 1st june so could be less than two weeks since test contact VOSA on monday morning. jj is right you need to get your money back, but complaint should be made anyway.

Good news I am getting fully refunded and they will be arranging a low loader to collect the car. To be honest I was suprised how quickly they will refund me as I though it be long winded.
Thanks everyone for your help and support, I now on the look out for another hopefully far superior than the one I had lol

Bad news about the car but good news on the refund. They didn't sell a product that was fit purpose, it was their fault and if you had paid on a credit card you could of gone through  the card provider to claim a refund - that would of peed them off.

You will find the right Brabus, it may take some hunting but now you know what to look out for. :)

Great news on getting the refund, but you've been extremely lucky for faults to have shown up quickly.
Please still complain to VOSA something is not right here and should be investigated.
